Fee Schedule

(Effective June 1, 2012)

Arizona Rates:

All preparation time and mediation time will be charged at $325 per hour.  Rates include hearings, conferences, review of briefs or documents, and research.

Out of State Rates:

All preparation time and mediation time will be charged at $350 per hour.  Rates include hearings, conferences, review of briefs or documents, and research.

Travel Expenses

Unless other arrangements have been made, if traveling outside of Maricopa County, travel time will be billed for one half of the trip.   Actual travel costs, including airfare, rental cars, etc. will not be billed.  If extended stay is required, hotel expenses and other incidentals will be billed.

Billing

Unless otherwise agreed to by the parties, fees will be divided equally among all participants and billings will be sent out at the end of each month.  In construction matters, unless otherwise agreed to by the parties, fees will be divided as follows:  1/3 to plaintiff, 1/3 to developer/general contractor and 1/3 to subcontractors.  Please be advised that all invoices will be sent to the attorney with the expectation that they will split the bill among their carriers.  All fees are due within thirty (30) days of receipt of our bill.  If fees are not received within 30 days, they are subject to 10% interest.  

Deposit

Unless otherwise agreed to in advance, for a full day mediation, a deposit of $3,000 ($1,500 from plaintiff and $1,500 from developer/general contractor) is required twenty-one (21) days in advance of the mediation date.  For a half-day mediation, a deposit of $1,500 ($750 from plaintiff and $750 from developer/general contractor) is required twenty-one (21) days in advance of the mediation date. All deposits will be held in trust until the fees have been accrued.  Please remit your payment to Southwest Dispute Resolution, LLC. 

Refund Of Fees / Cancellation Fee

Fees are fully refunded when notice of cancellation is received at least fourteen (14) calendar days before the scheduled date.  There is a 50% cancellation charge when notice of cancellation is received more than 7 and less than 14 days before the scheduled date and the time cannot be filled with other matters on my waiting list because of insufficient notice.  There is a 100% cancellation fee if the cancellation notice is received within 7 calendar days.
